WHAT IS MOOTING?

Mooting provides students with the opportunity to argue a fictional case in a court setup. Moot court competitions mimic how an actual court hearing would be conducted. Therefore, participating in moot court competitions familiarizes the students with all the courtroom protocols and etiquettes. Students are provided with a hypothetical fact sheet that revolves around different areas of law. After reading the facts of the hypothetical case thoroughly, students conduct an extensive legal research and prepare their written arguments in a legal brief (memorial) from both sides. Then, come the oral arounds, in which students deliver their submissions in front of a bench of judges. In turn, the judges ask questions from the participants (counsels). In the end, the proceedings adjourn and the judges provide the teams with their feedback.

Human Rights Act 1998 Under Review

The Human Rights Act 1998, set out by the European Convention on Human Rights (ECHR), is being reviewed with recommendations by the British government in summer next year. This review aims to analyse the structural framework of the act, reviewing the interpretation of HRA and its relationship with judiciary, executive and parliament. The reason behind this review presented by the British government is the perseverance of sovereignty of the Parliament. Due to HRA, the decisions made by ECHR enjoy constant supremacy over the domestic courts of the UK in terms of jurisprudence.

Critics declared this decision to review the Human Rights Act as another attempt to restore the UK’s status as a legal entity outside the EU. And as a tactic to escape any influence the European Union can have in the UK’s legal and political spheres. Losing HRA and jurisdiction of ECHR is being considered as an appalling prospect and a result of Brexit. The government has been receiving a lot of criticism for its cruel legislation, including deportation for non-UK nationals and refusal to pay for school meals for children. The announcement of this review during a worldwide pandemic, when legislation for human rights is already crucial, has given rise to a major criticism.

The review is a testament to the legal protections ensuring human dignity and will lead to an increase in human rights abuses, such as an increase in human trafficking.

The Army has always been steadfast to their sacred rule, and that is: we don't leave our men or women behind. At Blackstone School of Law, our teachers and staff proudly implement this policy in and outside of the classroom where we leave no student behind. We are proud of our efforts to increase the diversity in our classrooms and this means that we host students from all sorts of different linguistic, cultural and socioeconomic backgrounds. Because of the diverse backgrounds of our students, it is inevitable that some students struggle a bit more with the daunting monster that English law is! 5. The whole class and the teacher work as a team and together they win the battle.

Usama Malik Publication in Pakistan Law Digest

Blackstone is celebrating Mr. Usama Malik and his latest achievement of getting published in the Pakistan Law Digest (PLD), a leading law journal of Pakistan. PLD is a secondary source that discusses, explains, analyzes, and critiques the law. It is worth mentioning here that there have been instances, albeit rare, that judges may also cite the law journals in their decisions. It can be said that this makes PLD a powerful tool in shaping the law. Therefore, It makes us extremely proud that Usama Malik wrote a well-received and important study on the topic of International Arbitration - an area of law that still needs more exploration in Pakistan. We congratulate Usama Malik on this milestone in his academic career!
